If your loss of earnings and medical treatment expenses are going to be over $5,000 you need to lodge a Personal Injury Claim Form within 6 months from the date of the car accident.

Under the Motor Accidents Compensation Act lodgement of a Personal Injury Claim Form gives you access to additional personal injury compensation including:

(a) Payment or reimbursement of your reasonable medical and rehabilitation expenses;

(b) Payment or reimbursement of attendant care services;

(c) Lump sum compensation for your past economic loss caused by a loss of earnings by not being able to work after your car accident;

(d) Lump sum compensation for your future economic loss caused by a loss of earnings or earning capacity because of your injury including superannuation entitlements; and

(e) Non-economic loss if the car accident has caused you a permanent impairment of over 10%.
