Injury: Cervical spine – soft tissue injury • Loss of range of motion of left shoulder and pain radiating from the neck to the left shoulder on the basis of the Nguyen Injury Principle. • Lumbar spine – soft tissue injury.

History of the motor accident.

Our client was involved in a motor vehicle accident on 14 September 2018 at approximately 6:30 pm. She was the driver and sole occupant of a 1995 BMW 320i. She was wearing a seatbelt. The car was fitted with headrests. There was an airbag on the driver’s side which was not deployed. She was travelling approximately 15 km per hour. She was proceeding towards the Sydney Harbour Tunnel travelling in a southerly direction on the Warringah Highway just after the Miller Street overpass. Traffic ahead was slowing. Suddenly, she was hit from behind by a fire service truck. It was travelling quickly; the siren was not sounding. She could see it approaching in her rear-view mirror. The truck swerved hitting the left rear side of the vehicle pushing her on to the median strip. Fortunately, she did not strike oncoming traffic. She was not knocked out. She was able to get out of the vehicle. Police arrived. The vehicle was towed away and written off.
